THE FINE PRINT as reasonable and binding terms and conditions

DayjaLite Photo Productions (hereafter referred to as DLPP) reserves the distinct right to change, modify or cancel any and all terms and conditions at any time, without notice.

Wedding & Event Photography and Videography Agreement:

All advanced payment(s) is/are non-refundable.

DayjaLite Photo Productions (hereafter referred to as DLPP) agrees to provide the following photography/videography: _________ This event(s) may consist of family members, guests, other participants, and the general public as normally associated with this venue location and/or event. Any digital media presentation agreed upon will be made available within ___ days and any edited images agreed upon will be made available approximately ___ days after client provides DLPP with chosen images to be edited. (Videography: Any digital media presentation agreed upon will be made available approximately ____ days after the event).

In return for the mentioned goods and services, the undersigned agrees to make a payment of $__________. This payment is non-refundable, however, if DLPP is notified of any requested booking change at least 30 days before the date of the wedding, the change may be accommodated with no loss of deposit. The failure to notify DLPP of any change in date, time or place at least 15 days prior to the event will void the contract and free DLPP from such obligations as contained herein.

DLPP will not be held liable for any event participant(s) or guest(s) injury, regardless of incident, and/or for failure to provide any services or products due to negligence, carelessness or an accident or any other unavoidable action by any other individual, business or agency, necessary in performing the functions set forth in this agreement. In the event the photographer is in an accident or non-performance due to illness, DLPP will at their expense, provide a qualified back-up photographer or refund all money paid. DLPP may use images for social media and promotional purposes. Please refer to our website for all additional information.

All terms of this agreement are understood and agreed upon.

Payment for Services:

Any agreement, oral or written is a binding contract to provide services and receive payment for agreed services performed, on or before the date of agreed services are performed. All payment(s) are non-refundable. Cash, personal & business checks and credit/debit cards are accepted as forms of payment for advanced payment(s) and for any balance due. Credit card payments may incur a processing fee of up to 5% of the amount charged to any credit card. A $50.00 charge will be incurred on any returned checks for any reason. If payment in full is not received on or before agreed services are rendered, any and all final images, electronic storage and/or copyright release, will be withheld until payment is received in full, and any check provided as payment, clears DLPP's bank. Any additional chosen image "editing" requests over and above included "edited" images in any packages will incur a $3.00 per image charge. Custom image editing ("photoshop" work) will be quoted on a by image basis. Services provided through or as a representative of another entity are considered hourly and thus, charged hourly. Any and all agreed services and payments agreed upon, oral or written, over and above, referenced hourly services performed though and/of as a representative of another entity are the direct responsibility of the party agreeing to pay for and receive agreed services.

Service Premium:

Premium ($250) Arizona venues include, but not limited to: Laughlin Ranch Golf Club, London Bridge Resort and The Refuge Golf Club.

Premium ($1,000) Las Vegas venues include, but not limited to: All locations with a capacity greater than 25.

Premium dates are Friday and Saturday and Holidays may incur up to a $250 upcharge.

In addition and related to, or unrelated to a local or national crisis including a pandemic, DLPP reserves the right to and may add a service premium of $75-$150 to website published regular pricing of any and/or all services requested that are, but not limited to; "same-day", "immediately", beyond a reasonable production timing scope and/or if vehicle travel is required beyond 100 miles of 86442. Overnight and/or an extended travel distance and accommodations will be reviewed on a case-by-case basis.

Bookings:

DayjaLite Photo Productions reserve the sole and distinct right to book another client on first come first served basis for any date and/or time that is not already a confirmed booking with a signed agreement and payment received. Payment must be paid and agreement must be signed, to be considered booked.

DayjaLite Photo Productions and/or any of it's agent(s), representative(s) or owner(s) reserve the distinct right to refuse services to anyone, for any reason, at any time.

Price Matching and Promotional Offers:

DayjaLite Photo Productions may match and/or offer a promotional discount price, if and when offered: Client must provide a logo'ed piece of competitive literature or a proposal for services with the pricing displayed. Videography is not included in this offer.

Colleague and Industry Professional Responsibility:

DayjaLite Photo Productions works very closely with many and various wedding and event professionals and companies throughout it's service area. It is common and expected business courtesy and business practice for an industry colleague to give and receive photo and/or business identity acknowledgement, aka "credit" when another wedding or event company or individual, group or representative uses DayjaLite Photo Productions' work to enhance, sell, market, display, et.al. on or in any type of print, electronic or otherwise materials such as any social media posting, website, print or electronic literature, print or electronic advertising and/or any other type of presentation to the public. Notwithstanding any other agreement(s) the requestor and/or works user has in place with others, if photo credit is not provided or waived with approval of Jeff Lite only, any such image(s) requested will be provided with a DayjaLite Photo Productions identifying watermark. Store Credit:

"store credit" is considered a discount on a minimum retail purchase, discounts applied at the time of purchase.

Infant(s), Newborn(s) & Minor Child(ren) Photography/Videography:

DLPP and or it's photographer(s), agents, representatives, owner(s), agencies and or any other individual(s) associated with DLPP, may not be held liable for any infant(s), baby(s), minor(s) and or adult participant(s) or guest(s) injury, regardless of incident, and/or for failure to provide any services due to negligence, carelessness or an accident or any other unavoidable action by any other individual, business or agency, necessary in performing the functions set forth in the agreement. Parent(s) and or legal or otherwise guardian(s) assume the ultimate responsibility for the behavior and actions of their minor child(ren), newborn(s), infant(s), toddler(s), or otherwise, regardless of age, race, ethnicity, health status or any and all other matters regarding said child(res) or adult(s). These terms and conditions apply to outdoor locations, in-home locations, and or any on-site location(s).

Lake Mead, Lake Mohave and "River" Weddings & Photography/Videography Sessions:

There are several components that go into producing a wedding or photo shoot at the lake or on the river. NO ALCOHOLIC BEVERAGES AND/OR ILLEGAL DRUGS, including cannabis AT ANY TIME. No pets/animals or anyone under the age of 14. A wedding or photo shoot at the lake is an adventure and requires getting wet, riding in a boat, climbing on rocks and sand, and other types of walking hiking and climbing. Regular shoes (no heels), swimwear, towels and sunscreen is highly recommended. This is a fun adventure and is not designed for those that don't want to get a little dirt on them. Fuel upcharge may apply. Additional information will be provided by the studio. Attendees are limited to 4 and will require signing a liability waiver.

DLPP and or it's photographer(s), agents, representatives, owner(s), agencies and or any other individual(s) associated with DLPP, may not be held liable for any adult participant(s) or guest(s) injury, regardless of incident while driving yourself to the lake location, entering, riding or otherwise sitting, standing, exiting the boat and or engaging in any type of walking, hiking, stepping standing and any other maneuver while at the lake on the boat or on the beach area. INCLUDING any weather event, wind, rain, sunburn, or any other type of weather event, and or any act of god. Individuals assume the ultimate responsibility for the behavior and actions of themselves, or otherwise, regardless of age, race, ethnicity, health status or any and all other matters regarding said adult(s) and or guest(s). These terms and conditions apply to outdoor locations, in-home locations, and or any on-site location(s). DLPP may use images for social media and promotional purposes.

Grand Canyon Caverns Weddings & Adventures:

There are several components that go into producing a wedding or photo shoot at the Grand Canyon Caverns. NO ALCOHOLIC BEVERAGES AND/OR ILLEGAL DRUGS, including cannabis AT ANY TIME. A wedding or photo shoot at the Grand Canyon Caverns is an extreme adventure and requires being healthy and fit to be 220' below ground. Regular shoes (no heels), and other appropriate clothing and personal essential items are highly recommended. This is a fun adventure and is not designed for those that don't want to get a little dirt on them. Additional information will be provided by DLPP.
